<p>Hi, I&#8217;m Saul Carter here with Others Realty. We are one of Modesto&#8217;s leading short sale teams. I wanted to talk about cooperative short sales today. I&#8217;ve had a couple of clients in the past few months come to me and say they had this agent contact them on behalf of their bank, whether it&#8217;s Bank of America or GMAC or other banks as well. They want to do a short sale and they&#8217;re being prompted by the bank. It&#8217;s all well and good, the agents truthfully they&#8217;re trying to get more business and if they can get referrals from banks, more power to them. I have one issue with that though, there&#8217;s a bit of a conflict of interest. If I am getting all my business from a bank, and I&#8217;m in the middle of a short sale negotiation, and I know that I will not receive any more business from that bank if I don&#8217;t make sure that I keep them happy, who am I really representing? Am I representing the seller or am I representing the bank? </p>
<p>Now legally I have a fiduciary responsibility to the seller, which means I have to act in the seller&#8217;s best interest in all things. I do not have a fiduciary responsibility to the bank unless of course I have established one through some sort of contract. Either way, that is a huge conflict of interest and I don&#8217;t think that you can really represent your seller appropriately and by law if for some reason you have some sort of hidden and or disclosed relationship with the bank that is giving you referrals for cooperative short sales. </p>
<p>There are other problems with it, but that&#8217;s really the biggest one. So, for all those people out there who have been contacted by an agent, that says they represent Bank of America and they want to do a short sale, be weary of that. It doesn&#8217;t mean that that person is not a good person and can&#8217;t do a good job of representing you, just understand that they are coming from a place where they have a conflict of interest. When push comes to shove, who are they really going to represent? Here&#8217;s to doing short sales the Others way, where we are one of Modesto&#8217;s leading short sale teams. <p>For my blog topic today I wanted to talk about working on short sales in different parts of Modesto. I started doing short sales in the central valley of Modesto and it is certainly a very depressed region. This is mainly due to a lack of jobs and high unemployment which are two key reasons for a short sale. Lately I have also been working on short sales in the bay area as well. Short sales are not all that common in the bay area right now and I ran across a lot of agents who didn&#8217;t have much of any experience working on them. While home prices and the economy are doing better in the bay area the lack of knowledge can certainly hurt your chances of getting a short sale approval. Our team has handled short sales ranging between thirty thousand dollars and six hundred thousand dollars &amp; are willing to help any homeowners in need.</p>

<p>Hi, I&#8217;m Saul Carter here with Others Realty, one of Modesto&#8217;s leading short sale teams. I wanted to talk today about something that Chase is doing. It&#8217;s actually kind of weird but we have a short sale that we&#8217;ve been working on. The original offer was $179,000 and I originally had the property listed up in the $205,000 range by the time I actually got any offers whatsoever, I had it down to $175,000. I got an offer from an investor at $179,000. Over the course of literally four months of negotiating back and forth, Chase seems to believe that the value is at $224,000 and I couldn&#8217;t find anyone who was willing to pay over $179,000 when we first got it done. But this buyer was really engaged, they were willing to help out the seller, they understand and he&#8217;s a doctor and he&#8217;s got some cash or whatever. Over the course of an extra two months of negotiating, we actually got them down to $204,000 and got the buyer up to $204,000. </p>
<p>Well, when we got the approval letter sent over to us and there is a $20,000 seller credit in there, which I&#8217;m not sure how I&#8217;m going to explain that to the buyer and the buyer’s agent, but basically Chase has decided that this particular home fits into some category where they need to do something because maybe they feel like they have done something wrong or I&#8217;m not really sure why, but they have basically decided that they are going to give my seller $20,000 to close. It&#8217;s a short sale and she owes $450,000 and they&#8217;re selling it for $204,000. </p>
<p>So, anyway if you&#8217;ve got a Chase home loan out there and you need to do a short sale, I have no idea what the categories are, we are trying to investigate exactly how this property qualified for a $20,000 seller credit. When we figure that out, there will be another video and I&#8217;ll let you guys know. In the meantime, if you need to get a short sale done, we have the strategies to get it done and we will maybe even help get you $20,000. <p>Thanks for joining me; this is Saul Carter with Other&#8217;s Realty, one of the leading real estate and short sale teams in Modesto. Today I wanted to talk to you about various real estate designations, which are basically the various letters and abbreviations that realtors have behind their names. </p>
<p>As I mentioned in a previous video, we&#8217;ve recently completed our 76th short sale. What&#8217;s exciting about that is when you complete your 75th short sale transaction, you reach a higher designation. As a realtor, there are many opportunities for us to achieve different designations by going to seminars and taking educational classes. One of the main reasons I got my broker&#8217;s license is because it gave me a higher level of education over being a regular salesman. </p>
<p>I also have a short sale designation which is a short sale genius diamond. This is the level that I just obtained upon completing my 75th short sale. What&#8217;s nice about the designation that I have is that I&#8217;m not just going to a class for a few hours and then taking a test; I&#8217;m gaining short sale experience while trying to achieve a higher designation. With the short sale genius designation there are basically two components: a continuing education forum that occurs on a weekly basis and then there&#8217;s the number of short sales that you&#8217;ve completed. There are some designations out there, like the CEPE and the SFR, that I don&#8217;t really agree with after having done so many short sales of my own. </p>
<p>At the end of the day, I feel as if there&#8217;s no better way to gain a designation than getting short sales done. <p>For my blog today I really wanted to take a second and celebrate a special milestone in my career. Over the last two and half years I have completed seventy six short sales. No two files were the same, some took a week and some took forever but in the end I was able to help seventy six homeowners avoid foreclosure. I&#8217;m sure there are short sale teams around the country who have gotten more approvals than me but I can honestly say I brokered almost all of my files on my own. Of course I have added members to the Others Realty team over time as we have grown and it only continues to get bigger. Our team continues to expand because there are so many homeowners who trust us to help them avoid foreclosure.</p>
<p>This is a great situation to be in and I am excited about the future of helping homeowners in Modesto get out from under their distressed property. <p>I wanted to talk to you today about trustee sale dates. Some of the banks have actually gotten a little bit harder to deal with on these. A trustee sale date is actually the foreclosure date or the day they go on the courthouse steps and try to sell your home. I&#8217;ve recently talked to some clients that have tried to change their trustee sale dates; although I have gotten lots of trustee sale dates postponed, if you have one, I need you to call me right away. I&#8217;ll do everything that I can to help you, however my odds of actually being able to actually get that fixed for you decrease the longer you wait to call me. </p>
<p>In working with some lenders, such as Fannie Mae, they&#8217;ve actually told me that they won&#8217;t postpone the trustee sale date for any property they don&#8217;t have a short sale approval letter for. I&#8217;ve gotten past that roadblock with them, but it takes a lot of effort and you have to know exactly what you are doing and who to talk to. </p>
<p>If you have a trustee sale or you have missed more than a few payments and you think you might have to do a short sale, call me now because waiting is way too risky. Once you have that trustee sale date, the odds of actually getting a short sale done go way down. It doesn&#8217;t mean that doing a short sale isn&#8217;t possible, however, you need to contact me immediately. Please either give me a call or fill out the &quot;Getting Started&quot; form on our website. Others Realty can help you short sell your home, so please contact us today.</p>

When you&#8217;re in a short sale, there is the short sale package which is bank statements, financial statements, pay stubs, taxes, and all that stuff. Well as we go through the transaction, we&#8217;ve gotten an offer; we&#8217;ve sent off the short sale package, the bank is going to ask for updated documents. I&#8217;ve actually had some clients recently who have asked how things were going, and I&#8217;ve had to tell them I&#8217;ve been waiting for documents from them for two weeks now. I remind them that I&#8217;ve sent several emails. Well, things get put on hold if you are asked by the bank for documents and you don&#8217;t provide them. </p>
<p>It&#8217;s important, and one of the things I always have my sellers sign is a seller’s expectations document. It outlines the short sale process and all of the things that are required of them. I take it seriously. I want them to be just as involved as I am to get this done for them. No matter you try to help somebody, if they aren&#8217;t involved it&#8217;s not going to happen. Basically if there have been any short sales that I haven&#8217;t gotten approved; I can specifically point to sellers not being engaged in why that happens. </p>

<p>Hey, I&#8217;m Saul Carter here with Others Realty, one of Modesto&#8217;s leading short sale teams. I wanted to talk today about a do not call letter or a cease communication letter. Basically that&#8217;s a letter by the fair credit reporting act that if you notify the bank in writing that you don&#8217;t want them to contact you, they are not allowed to contact you by law. Now the stipulation is they have to be able to contact somebody, so once we have the third party authorization then you can go ahead and send the do not call letter. </p>
<p>It&#8217;s one of those things that a lot of my sellers really appreciate because when they do a short sale with me and I send off the do not call letter or the cease communication letter then they do not get calls in the evenings. Sometimes it takes the bank a little while to figure it out, like I&#8217;ve sent it in but they haven&#8217;t told the right department, but we&#8217;ll get them taken care of. </p>
<p>Finding out a way to stop these calls is one of the things that a lot of my sellers really appreciate. Anyway, here&#8217;s to doing real estate the Others way. <p>I wanted to talk to you today about a specific document that doesn&#8217;t show up in everyone&#8217;s short sale package, but that I do have as part of mine. It&#8217;s something called a loan modification waiver, and I would assume that over time most realtors will start to include them in their short sale packages. The loan modification waiver is a document that states you have considered doing a loan modification and it&#8217;s either not in your best interest or you don&#8217;t want to do a loan modification anymore. </p>
<p>When we&#8217;re working together to short sell your home, this document works to our advantage and puts your declination of doing a loan modification in writing for when I send your short sale application into the bank. It also ensures that the paperwork goes to the right department at the bank; I&#8217;ve had instances in which there has been some confusion with the bank when this document isn&#8217;t included in the short sale package and they think that I am actually applying for a loan modification instead of applying for a short sale. I&#8217;ve included this loan modification waiver document to avoid this type of confusion in the future; this also helps if you have been doing a loan modification and notifies the bank in writing that you don&#8217;t want to continue with the loan modification anymore and are going to do a short sale. <p>Hey, I&#8217;m Saul Carter here with Others Realty where we are Modesto&#8217;s leading short sale team. I wanted to talk to you today about filling out the paperwork the bank sends you. I talk to a lot of sellers that have already received something from the bank and they have filled out as much as they could and sent it off to the bank in hopes to try to get things moving. It&#8217;s not effective, don&#8217;t do it, talk to somebody who has done a multitude of short sales before sending that paperwork off. </p>
<p>Typically the paperwork is already oriented to being in escrow or already having a buyer so you need information that would be on a HUD statement. The other part of it is they ask you all kinds of crazy intrusive questions that we don&#8217;t even answer when we fill out our normal short sale package. They are just asking you to over disclose about everything they want to know. Keep in mind this whole thing; whether it&#8217;s a short sale or foreclosure, they are all activities trying to get money out of you. </p>
<p>So if you keep that mindset and employ an expert like me at Others Realty, to guide you through this, we will get you taken care of and we won&#8217;t over disclose it to the bank and we will get this done with as minimal amount of stress on you as possible. </p>
