I wanted to talk to you today about trustee sale dates. Some of the banks have actually gotten a little bit harder to deal with on these. A trustee sale date is actually the foreclosure date or the day they go on the courthouse steps and try to sell your home. I’ve recently talked to some clients that have tried to change their trustee sale dates; although I have gotten lots of trustee sale dates postponed, if you have one, I need you to call me right away. I’ll do everything that I can to help you, however my odds of actually being able to actually get that fixed for you decrease the longer you wait to call me.
In working with some lenders, such as Fannie Mae, they’ve actually told me that they won’t postpone the trustee sale date for any property they don’t have a short sale approval letter for. I’ve gotten past that roadblock with them, but it takes a lot of effort and you have to know exactly what you are doing and who to talk to.
If you have a trustee sale or you have missed more than a few payments and you think you might have to do a short sale, call me now because waiting is way too risky. Once you have that trustee sale date, the odds of actually getting a short sale done go way down. It doesn’t mean that doing a short sale isn’t possible, however, you need to contact me immediately. When is a Good Time to Update Your Documents with the Bank?
Hey, I’m Saul Carter with Others Realty, Modesto’s leading short sale team. I wanted to talk today about updating your documents. When you’re in a short sale, there is the short sale package which is bank statements, financial statements, pay stubs, taxes, and all that stuff. Well as we go through the transaction, we’ve gotten an offer; we’ve sent off the short sale package, the bank is going to ask for updated documents. I’ve actually had some clients recently who have asked how things were going, and I’ve had to tell them I’ve been waiting for documents from them for two weeks now. I remind them that I’ve sent several emails. Well, things get put on hold if you are asked by the bank for documents and you don’t provide them.
It’s important, and one of the things I always have my sellers sign is a seller’s expectations document. It outlines the short sale process and all of the things that are required of them. I take it seriously. I want them to be just as involved as I am to get this done for them. No matter you try to help somebody, if they aren’t involved it’s not going to happen. Basically if there have been any short sales that I haven’t gotten approved; I can specifically point to sellers not being engaged in why that happens.

What is a Do not Call Letter and How Can it Help Me?
Hey, I’m Saul Carter here with Others Realty, one of Modesto’s leading short sale teams. I wanted to talk today about a do not call letter or a cease communication letter. Basically that’s a letter by the fair credit reporting act that if you notify the bank in writing that you don’t want them to contact you, they are not allowed to contact you by law. Now the stipulation is they have to be able to contact somebody, so once we have the third party authorization then you can go ahead and send the do not call letter.
It’s one of those things that a lot of my sellers really appreciate because when they do a short sale with me and I send off the do not call letter or the cease communication letter then they do not get calls in the evenings. Sometimes it takes the bank a little while to figure it out, like I’ve sent it in but they haven’t told the right department, but we’ll get them taken care of.
Finding out a way to stop these calls is one of the things that a lot of my sellers really appreciate. Anyway, here’s to doing real estate the Others way. Does Your Realtor Include A Loan Modification Waiver In Their Short Sale Package?
Hi, this is Saul Carter with Others Realty. I’m one of the leading short sale experts in the Modesto area. I wanted to talk to you today about a specific document that doesn’t show up in everyone’s short sale package, but that I do have as part of mine. It’s something called a loan modification waiver, and I would assume that over time most realtors will start to include them in their short sale packages. The loan modification waiver is a document that states you have considered doing a loan modification and it’s either not in your best interest or you don’t want to do a loan modification anymore.
When we’re working together to short sell your home, this document works to our advantage and puts your declination of doing a loan modification in writing for when I send your short sale application into the bank. It also ensures that the paperwork goes to the right department at the bank; I’ve had instances in which there has been some confusion with the bank when this document isn’t included in the short sale package and they think that I am actually applying for a loan modification instead of applying for a short sale. I’ve included this loan modification waiver document to avoid this type of confusion in the future; this also helps if you have been doing a loan modification and notifies the bank in writing that you don’t want to continue with the loan modification anymore and are going to do a short sale. What to do With All the Paperwork Sent to You from the Bank
Hey, I’m Saul Carter here with Others Realty where we are Modesto’s leading short sale team. I wanted to talk to you today about filling out the paperwork the bank sends you. I talk to a lot of sellers that have already received something from the bank and they have filled out as much as they could and sent it off to the bank in hopes to try to get things moving. It’s not effective, don’t do it, talk to somebody who has done a multitude of short sales before sending that paperwork off.
Typically the paperwork is already oriented to being in escrow or already having a buyer so you need information that would be on a HUD statement. The other part of it is they ask you all kinds of crazy intrusive questions that we don’t even answer when we fill out our normal short sale package. They are just asking you to over disclose about everything they want to know. Keep in mind this whole thing; whether it’s a short sale or foreclosure, they are all activities trying to get money out of you.
So if you keep that mindset and employ an expert like me at Others Realty, to guide you through this, we will get you taken care of and we won’t over disclose it to the bank and we will get this done with as minimal amount of stress on you as possible.
